A Brighton man accused of murdering his former roommate was arraigned yesterday. According to court documents 23 year old Maxwell Wyant pled not guilty to second degree murder charges. Wyant is accused of fatally shooting his former roommate – 21 year old Christoper Schoen – on February 8th at a Hartfeld Drive home in Brighton. Police say Schoen died from a shotgun blast. His body was found outside the home. Wyant is being held in the Monroe County Jail in lieu of 500 thousand dollars bail.

The case of a Henrietta teen accused of stabbing his cousin multiple times is now in the hands of a Monroe County jury. The jury started deliberations yesterday on the fate of 16 year old Faheem Abdul-Jaleel who is charged with second degree attempted murder and first degree assault in connection with the stabbing of 13 year old Samina Quasim last June. Abdul-Jaleel is accused of stabbing his cousin 12 times in the neck. During testimony his lawyer is claiming it was an act of self-defense.

A Clyde man is accused of receiving thousands of dollars in welfare benefits he was not entitled to. According to the Wayne County Sheriff’s Department Howard W. Frazer the Third of West Genesee Street is accused of receiving public assistance for a child who was not living with him. Sheriff’s Deputies say Frazer received at least two thousand dollars he was not entitled to.

Police in Irondequoit arrested two men in connection with a burglary at a home on Vinal Avenue and another man for an attempted burglary at a Forest Avenue home. Police say the homeowners at the Vinal Avenue residence woke up around 4:30 Wednesday morning to their dogs barking. They then discovered the rear door open and property missing. Following an investigation police arrested two suspects in the area. 24 year old Kasheen McGill and 20 year old Carlos Ortega Junior are facing various charges in connection with the case.

Meanwhile, police also arrested a suspect in a separate incident on Forest Avenue. Officers responded to a call of a suspicious man trying to enter a vacant home. When they arrived on the scene they found 32 year old Jeremy Borsching of Irondequoit attempting to break into the home.

Police say one person is listed in critical condition after a double shooting in Syracuse. Authorities say a black Honda pulled into a driveway of a home, followed by a grey SUV. An occupant in the SUV then opened fire on the Honda and fled the scene. Investigators report that 15 year old Ronnie Daniels is listed in critical condition in the hospital while 17 year old Lamyke Kelly was also injured in the shooting.

Meanwhile, after the shooting, authorities say the driver of the Honda followed the SUV until running a red light and crashing into another vehicle. The driver attempted to flee the scene but a witness stopped him and held him there until police arrived on the scene.

A Brighton man accused of killing his former roommate made a court appearance yesterday for his arraignment. 23 year old Maxwell Wyant was arraigned in Monroe County court after a grand jury indicted him last week on a charge of second degree murder. Rochester firefighters battled a stubborn fire in a vacant house at 139 Morrill Street. When firefighters arrived on the scene the structure was fully engulfed in flames. It took crews approximately an hour to get the fire under control. The cause of the fire remains under investigation but officials have determined it to be “suspicious” in nature. No injuries were reported in the fire.

Two men from Miami are in the Orleans County Jail as they stand accused of possessing dozens of fake credit cards and attempting to make purchases using the cards at a Wal-Mart in Albion. Sheriff’s Deputies say 45 year old Felix Darias and 35 year old Yoel M. Pena are facing a number of charges in connection with the case. Both men are being held in jail on 50 thousand dollars bail. Sheriff’s Deputies say the investigation is on-going and more charges could be filed as federal agencies are also investigating the men in connection with similar crimes in other parts of the country.

New York state is opening an eBay store to sell off unused state vehicles and other assets. According to a spokesperson from Governor Andrew Cuomo’s office, the state has identified approximately 500 vehicles that will be part of the first round of products in the NYS-Store which will debut on eBay in April. Other surplus good for sale will include office supplies, computers, cell phones, furniture, medical equipment, cameras, generators and tools.

Officials say there is finally snow on the ground and it’s just in time for the annual Sno-Cross Championship Series at the Finger Lakes Casino and Race Track. The snowmobile championship was originally scheduled for earlier this month but there wasn’t enough snow to build the track. But now organizers say hundreds of racers are gathering at the track for the weekend slate of races. Professional drivers, as well as semi-pro drivers, are competing for titles in 125 different races at the AMSOIL Championship Sno-Cross Series Eastern Nationals.

Authorities in upstate New York are investigating the death of an Amtrak passenger who was apparently dragged by a train after being kicked off for drunkenness. Police say the 44 year old man from Schenectady got off the Chicago-bound train after it arrived in Rochester late Tuesday. Officials say when he tried to re-board the conductor refused to let him back on because he’d disturbed other passengers earlier. Authorities believe he was then dragged by the train after trying to jump back on as the train left the station.

New York State Police are investigating a horseback riding accident that claimed the life of a Fairport woman. Authorities say Kaylee Rizzo-Brien was riding near a farm in Palmyra when she apparently fell off the horse. She was not wearing a helmet at the time of the accident. Rizzo-Brien was found along Lyone Road and pronounced dead at the scene.

Federal prosecutors say 40 year old Thomas Cramer enticed six girls under the age of 18 to work as prostitutes. The alleged crimes took place at Cramer’s residence and hotels in Rochester, Syracuse and Buffalo. According to court documents the incidents took place between 2008 and February of this year. The Criminal Complaint alleges that Cramer charged customers up to 220 dollars an hour. Authorities also report that he placed ads on Craigs-List and adult web sites regarding the availability of the minor females for sex acts.

Geneva Police say the third person wanted in connection with a robbery from last week is now in custody. Skyler Bailey – who was considered armed and dangerous – was arrested yesterday in Waterloo after a Police Officer recognized him. Bailey and two others are accused of robbing a man inside his home on Exchange Street on February 17th. The victim told police two men and a woman said they had a gun, pushed him down and took money and property from him.

The Waterloo Central School District is not allowing a senior to attend her ball with her fiance – a Marine who will be deployed to Afghanistan soon. 18 year old Shawna Excell said her fiance will be in Afghanistan for her graduation so he was going to attend her Senior Ball on March 3rd. However, the School Principal points to a statement on the School Districts website saying the district prohibits students from taking non-Waterloo graduates as guests to dances.

The president of a payroll service business in Rochester has been sentenced to eight years in federal prison and more than 3.7 million dollars in restitution in a tax-fraud case. 51 year old Jeffrey Sykes of Canandaigua was the president of the now-defunct Paybooks Incorporated which served approximately one thousand clients. He pled guilty in October to engaging in monetary transactions using the proceeds of a tax fraud. Prosecutors say Sykes was responsible for paying withholding employment taxes to the Internal Revenue Service on behalf of his clients. However, he instead used the funds to operate Paybooks and to make personal expenditures.

A teenager from Clifton Springs is dead following a fiery crash in Penfield. Monroe County Sheriff’s Deputies say a car crashed into a utility pole, a tree and then burst into flames after crashing on Jackson Rod near State Road around 2 o’clock yesterday morning. Officers on the scene said the driver of the vehicle – 19 year old David Groff – was ejected from the car and pronounced dead at the scene. The cause of the crash remains under investigation.

45 year old Michael Hoffman of Route 96 in Waterloo made a court appearance yesterday in connection with a murder for hire plot. According to court documents, Hoffman agreed to pay an undercover police officer with the New York State Police Department two thousand dollars to murder a person. He also supplied the officer with a picture of the intended victim. Authorities also say Hoffman agreed to pay one thousand dollars to another undercover officer to break the legs of another victim.

Meanwhile, investigators also say the alleged intended assault victim is the husband of a woman that lives with Hoffman with her children and grandchildren. The alleged intended murder victim is a man Hoffman suspected of having relations with the intended assault victim’s wife. Hoffman remains in the Seneca County Jail in lieu of 50 thousand dollars bail.

A Judge is expected to rule soon on whether to move a slander case against Syracuse University and its head basketball coach from a New York City court to Syracuse. Former ball boys Bobby Davis and Michael Lang claim Coach Jim Bay-heim defamed them by saying they were out for money after allegations of abuse by former assistant coach Bernie Fine surfaced in November of last year. Lawyers for Davis and Lang filed the defamation suit in New York City saying their clients cannot get a fair trial in a community where S.U. has extreme economic and emotional influence.

In another sign of slow economic recovery in New York’s communities, sales tax revenue last year matched or exceeded pre-recession levels of 2008 in most parts of the state. According to a recent report from the State Comptroller’s Office, sales tax collections grew by five percent last year. While admitting that higher sales tax collections are a “good sign” Comptroller Thomas DiNapoli also said “continued caution is warranted” as growth has been somewhat sluggish.

Buffalo Sabres fans can now stay connected to the team on their smart phones, with the iPhone, Android and Blackberry apps. According to a press release from the team the Sabres are now offering a wide variety of functions on their mobile application. The Buffalo Bills will keep season ticket prices flat for the 20-12 season. In an announcement yesterday the team announced that some ticket prices will drop. The Buffalo Bills will play nine games – including preseason games – at the Ralph Wilson Stadium this season. The team will again play another regular season game at the Rogers Center in Toronto.

A 58 year old Saratoga Springs man is recovering after a frigid night on New York’s highest peak. Dave Winchell of the Department of Environmental Conservation says forest rangers found the man near the top of Mount Marcy yesterday. Stephan ma-STAY-this was hoisted into a hovering helicopter and then flown to the Adirondack Medical Center in Saranac Lake. Officials say he was conscious but cold after an overnight wind chill of 20 below.

Geneva City Police are searching for a man they say should be considered armed and dangerous. The third suspect in connection with a robbery last week on Exchange Street in Geneva has been identified as 23 year old Skyler T. Bailey of Seneca Falls. The two other suspects in the robbery were arrested in Clyde and are currently being held in jail in lieu of bail.

A registered sex offender from Wayne County was back in court yesterday for his arraignment on charges that he allegedly abused three girls. Richard Daley is accused of abusing the three children – including a nine year old – over the course of two years in Monroe County. According to court documents, Daley served time in prison in the 1990’2 for raping a 13 year old girl.

A Canandaigua man has been charged with second degree identity theft. According to the City of Canandaigua Police Department, 58 year old Richard C. Streeter allegedly used another person’s ATM and PIN information to withdraw money from several locations within Canandaigua, exceeding 500 dollars in withdrawals. Streeter was arraigned and then remanded to the Ontario County Jail without bail.

A man was injured in a single car crash last night at the intersection of Mount Read Boulevard and Emerson Street last night. Authorities say the driver lost control of his vehicle, spun and hit a post. The man was trapped for a short time inside the vehicle while rescue crews worked to free him. He was then transported to Strong Memorial Hospital for treatment of what were described as non-life-threatening injuries.

Emma Andrew of Newark has been named the New York State Dairy Princess for 2012-13. The two day competition at the Holiday Inn on Electronics Parkway in Salina concluded last night with the crowning of Andrew who will now represent the American Dairy Association and Dairy Council, as well as the dairy industry at fairs, farm meetings and special events throughout the state for the next year.

Police in Canandaigua say a man missing since Sunday has been found. According to the Canandaigua Police Department, Harvey Walters – who is a paranoid schizophrenic and insulin-dependent diabetic – was found safe. Authorities say he left the area on his own and was found in California last night.

The trial is now underway for a New Jersey bus driver charged in the deaths of passengers killed in a collision with a railroad bridge outside Syracuse. John Toma-see-ski in on trial in an Onondaga County Court room on four charges of criminally negligent homicide and one count of failure to obey a traffic control device.

Meanwhile, prosecutors say Toma-see-ski was checking a personal global positioning system device and had ignored numerous signs warning of a low bridge ahead when the Megabus he was driving crashed into the CSX-owned span over the Onondaga Lake Parkway in September 20-10. Four people were killed in the crash and two dozen more were injured.

An Orleans County Sheriff’s Deputy – accused of repeated domestic violence against his estranged wife – has accepted a plea deal. 38 year old Jason Sillman was indicted last year on 42 criminal charges, including assault, harassment and contempt of court. Sillman was also suspended without pay from the Orleans County Sheriff’s Department after his indictment was handed up.

The new Director of Aviation was announced yesterday by County Executive Maggie Brooks at the Greater Rochester International Airport. The airport has been without an Airport Director since Susan Walsh resigned on January 3rd. Walsh had been charged with DWI after a crash in East Rochester on December 22nd. Walsh’s resignation came just a year after her predecessor – David Damelio – resigned amid a scandal that he spent excessively on tobacco and alcohol while charging it to the Airport’s expense account.

Three women are facing charges after a prostitution sting at two motels in Horseheads. Officials say the arrests followed undercover operations by the Horseheads Police Department and the Chemung County Sheriff’s Office. According to court documents, 20 year old Page Kirsh-blum and 24 year old Angela Turner – both of Rochester – were arrested at a Motel Six.

Meanwhile, authorities say 24 year old Nicole Kuz-min of East Islip was arrested in a separate raid at the Red Carpet Inn. All three suspects were arraigned and then remanded to the Chemung County Jail in lieu of bail.

A 40 year old Savannah man has been arrested on a charge of fourth-degree grand larceny. Police say Frederick Young stole a credit card from his former employer – a trucking company in Ontario County – and made thousands of dollars in fraudulent charges in Ontario, Wayne and Seneca Counties. Young was arraigned and then remanded to the Ontario County Jail without bail. The investigation is on-going and Sheriff’s Deputies say further charges are pending in the case.

The owner and developer of The Mall at Greece Ridge was at the Greece Town Hall yesterday for a public hearing on proposed tax breaks. Wilmorite has applied for 3.6 million dollars in tax incentives as part of an 11 million dollar project to redesign the space left behind by the departing Bon-Ton store. Wilmorite is hoping to fill the void with restaurants and smaller boutique-style shops.

The Rochester Fire Department has released the names of the four young victims killed in a weekend fire. Officials report that 14 year old Gage Reavey, 13 year old Gregory Kugler, 12 year old Kandee Kugler and 6 year old Kaiden Kugler were all pronounced dead at the scene of the Grape Street fire.

Meanwhile, fire crews were originally called to the scene for a report of a rubbish fire outside the duplex home. As firefighters checked the home they noticed flames and smoke coming from the first floor. Firefighters rescued 30 year old Bobbie Kugler and her two year old son Tyron Jackson. Kugler is also the mother of the four children who were killed in the fire.

A Macedon man is charged with arson after allegedly setting his ex-girlfriends garage on fire earlier this month. Police say 31 year old Brent Ashley is additionally charged with burglary from two incidents on the same day. According to the Wayne County Sheriff’s Department both incidents took place on February 5th. Ashley is accused of damaging his ex-girlfriends car by rolling it into another vehicle at the American Legion. Minutes later, Sheriff’s Deputies say he intentionally set a garage on fire at the woman’s house on Erie Street in Macedon. Ashley was arraigned and then remanded to the Wayne County Jail in lieu of bail.

Rochester Police have charged the man who left his sleeping son in a car that was then stolen Saturday night. 26 year old Phillip Owens of Irondequoit was charged with endangering the welfare of a child. Owens told police he left his six year old son in his running car on West Main Street. He said he stopped the car outside a convenience store and went inside to buy a drink. While Owens was inside the store, someone got into his car and drove off with the boy sleeping inside. The car was found abandoned a short time later with the boy still sleeping in the backseat.

A pair of Dundee residents have been charged with allegedly selling drugs to undercover police officers, some of which took place in the presence of young children. 29 year old Heather Charette and 31 year old Larry Cheeks were both arrested on Superior Court warrants after being indicted by a grand jury. Both are accused of selling cocaine and heroin.

The Waterloo Fire Department and Waterloo Police Department responded to a structure fire at 19 Amherst Road yesterday morning. When they arrived on the scene fire crews found an attached garage to the building fully engulfed in flames. The fire was contained to the garage area. Authorities also report that Gary Chilson and Linda Sandman – the residents of the home – escaped the fire safely with their infant grandson and family pets and then called 9-1-1. The cause of the fire remains under investigation.

The International Association of Machinists and Aerospace Workers Union representing manufacturing and maintenance employees at Garlock Sealing Technologies facility in Palmyra has ratified a new five year contract. Garlock’s offer included wage increases in each of the next five years as well as a reduction in medical insurance contributions. The company will also provide enhancements to pension and retirement savings programs.

Federal authorities say an upstate New York man has admitted to conspiring to violate the Clean Water Act and lying to government agents about dumping debris in wetlands near the Mohawk River. According to prosecutors, Julius DeSimone of Rome pled guilty in federal court to two felony counts and could face up to five years in prison for helping dump 81 hundred tons of pulverized construction and demolition debris from New York and New Jersey at a farmer’s property. Court documents say he and others concealed the illegal dumping by fabricating a state permit.

A man standing between two parked SUV’s was injured when another vehicle crashed into one of the parked vehicles. According to the Monroe County Sheriff’s Department the two SUV’s were facing each other on the side of East Henrietta Road under the Brighton-Henrietta Townline Road overpass. One of the vehicles had a dead battery and people were attempting to jump start it with the other vehicle. A northbound SUV went off the road and hit the rear of one of the parked SUV’s, pushing it into the man. It then crossed into the other lane of traffic and hit another vehicle.

Meanwhile, officers on the scene said the man – who suffered a broken leg and other non-life-threatening injuries – was transported to Strong Memorial Hospital for treatment. Three people who were standing near the SUV’s were also transported to Strong Hospital for treatment of minor injuries. The accident remains under investigation.

The IRS is battling crooks who are trying to steal your refunds. Identity theft has surged with the increase of e-filers and the IRS estimates more than 400 thousand people have been victimized by identity theft tax fraud from mid-2009 to the end of 20-11. The IRS has added new security filters and flagged more than a quarter of a million returns based on identity theft from last year.

The Wayne County Sheriff’s Department reports the arrest of an Arcadia man on charges of disorderly conduct, obstructing governmental administration and resisting arrest. Sheriff’s Deputies arrested 25 year old Evan P. Welcher after he was seen walking down the center line of Route 88 impeding the flow of traffic. When officers arrived on the scene he refused to move from the middle of the road and continued to obstruct traffic. When Sheriff’s Deputies attempted to take him into custody he started fighting with them.

Authorities say a woman is under arrested after an accident on the Lake Ontario Parkway. Investigators report that 33 year old Amy Stot-hard swerved to avoid hitting a turtle and hit another vehicle – driven by 53 year old Patricia Neary of Hilton. According to the Monroe County Sheriff’s Department both women sustained minor injuries. A passenger in Neary’s car – 53 year old Edward Demp-ski was not injured in the crash. Stot-hard was charged with aggravated DWI, DWI and a number of other violations in connection with the crash.

First Niagara Financial Group Incorporated expects to complete its acquisition of HSBC Bank on May18th. According to a press release, after that nine First Niagara Bank’s or HSBC branches in the area will be closed. After acquiring 195 HSBC branches in Upstate New York and Connecticut, First Niagara will consolidate 34 branches with HSBC branches statewide and one in Connecticut.

Rochester police say shots were fired at a car late Sunday morning. The 23 year old victim’s car was hit several times by gunfire in the 13 hundred block of North Clinton Avenue. No injuries were reported and police are continuing their investigation into the incident.

A 21 year old victim is now fighting for his life after he was stabbed several times outside a bar last night. Officials say when officers arrived on the scene outside the Venu Nightclub on St. Paul Street, it was – quote – “chaotic”. Investigators say the fight that started inside the bar spilled out onto the sidewalk. During the fight the victim was stabbed several times in the torso and suffered what are described as life-threatening injuries. He was carried back inside the nightclub until medics arrived on the scene. Police do not have any suspects in custody and are continuing their investigation.

Two suspects are in Ontario County Jail after being charged in connection with a robbery on Exchange Street in the City of Geneva. The two suspects – 18 year old James Alan Jones and 17 year old Rachelle Jean Adams – were located in Clyde and then arrested on charges of first degree robbery. A third suspect – who is known to the Geneva Police Department – is still at large but an arrest is expected.

Meanwhile, authorities say officers responded to a fifth floor apartment in a building on the 500 block area of Exchange Street for the report of a robbery in progress. The three suspects allegedly threatened the victim with a gun, pushed the victim to the ground and stole an undisclosed amount of cash as well as other property. The victim did not suffer any injuries in the incident, but was transported to Geneva General Hospital for observation.

Rochester police reunited a six year old child with his father after the family’s car was stolen with the boy asleep in the back seat. Officials say the search started around 10:30 Saturday night after a man pulled into a variety store in Rochester. The driver left the car running as he went into the store and that’s when police say a suspect got into the running car and drove away. The car was found abandoned about two hours later in the area of Garson Avenue and 4th Street. Officers found the boy still asleep in the backseat of the vehicle. Investigators are continuing their search for the suspect who stole the vehicle.

U.S. Food and Drug Administration officials plan to investigate whether inhalable caffeine sold in small canisters is safe for consumers. Aero-Shot went on the market last month in Massachusetts and New York. Each canister contains the caffeine equivalent of a large cup of coffee. Officials say Aero-Shot did not require FDA review because it is sold as a dietary supplement. However, U.S. Senator Charles Schumer is concerned about over-use of the product, particularly by young people.

Rochester firefighters responded to a home on the city’s west side Saturday morning for a report of a rubbish fire that ended up killing four children. Upon arrival on the scene fire crews found what they described as a pile of burning clothes on the property in front of the house. They entered the home and initially did not find anyone. However, a second search of the house found flames and smoke coming from the first floor and two people trapped inside. Both were rescued and transported to the hospital for treatment of injuries sustained in the fire.

Meanwhile, fire officials then received word there were four people trapped on the second floor of the building as well. Intense heat and flames kept firefighters from reaching the victims. Once the fire was extinguished four children ranging in ages from below 10 and to their early to mid-teens were discovered on the second floor. They were all pronounced dead at the scene.

Rochester Police are searching for a suspect in a shooting on Conkey Avenue near Avenue C which took place Saturday morning. Officers were called to a double shooting and when they arrived on the scene they found one person with a gunshot wound. The victim was transported to Rochester General Hospital for treatment. Police say a second victim involved in the shooting was taken to the hospital in a private car. Both sustained what were described as non-life-threatening injuries.

Sheriff John York of the Livingston County Sheriff’s Department reports that Deputies arrested a Canandaigua man in connection with a hit and run in Geneseo. Authorities say the arrest stems from an accident where 22 year old Andrew F. Jackson hit another vehicle while he was attempting to pass the car. After the accident Jackson fled the scene but a witness to the accident called 9-1-1. Jackson was later interviewed by Sheriff’s Deputies and then arrested on a number of charges. The driver of the second vehicle was not injured in the crash.

A 59 year old Seneca Falls woman is being treated at Strong Memorial Hospital for injuries she sustained in a single car crash on Route 96 in the Town of Phelps. Ontario County Sheriff’s Deputies say Jo-Ann Greenfield apparently fell asleep at the wheel Saturday morning before her car crossed the center line, went up an embankment on the side of the road, hit a tree and then power pole before coming to a stop.

A 66 year old Canandaigua man was charged with first degree sex abuse over the weekend. According to the Canandaigua Police Department, John C. Mi-shock is accused of subjecting a three year old girl to sexual contact while at his home in January. Further charges are pending in the case. According to court documents the Canandaigua Police Department was assisted in the investigation by the Ontario County Department of Social Services. Mi-shock was arraigned and then remanded to the Ontario County Jail in lieu of 25 thousand dollars bail.

Ontario County Sheriff’s Deputies arrested a man on a charge of petit larceny for stealing livestock from his neighbor. Authorities say 51 year old Robert Pool stole two lambs from his neighbor last week. Pool was later arrested and the lambs were returned to their owner. Pool will appear in court at a later date to answer the charge.

Police say a drunk driver going the wrong way is to blame for a three car crash on the Inner Loop last night. Authorities say 38 year old Angeline Roscoe was driving westbound in the eastbound lanes when she crashed into another car near the University Avenue Exit. That car then crashed into a third car which had two people in it. Roscoe was rushed to Strong Memorial Hospital with critical injuries while the other three victims in the crash were transported to the hospital for what were described as non-life-threatening injuries.

Meanwhile, both New York State Police and officers from the Rochester Police Department were on the scene through the night investigating the crash. Portions of the eastbound lanes were shut down temporarily during the overnight. Roscoe has been charged with DWI.

Three people were transported to the hospital last night after a crash involving a car and a tractor-trailer on Routes 5 and 20 in Bloomfield. According to Ontario County Sheriff’s Deputies on the scene the injuries were not life-threatening. Investigators also say the car was demolished in the crash littering debris along the roadway.

Daniel E. Ferris – who pled guilty to third degree assault in December after shooting himself in the foot while trying to shoot his girlfriend in Greece in April – was sentenced to time served and released from jail yesterday. Ferris had been behind bars since his arrest on April 16th of last year. He was initially charged with attempted second degree murder, third degree assault and second degree unlawful imprisonment. He pled guilty to an assault charge on December 8th.

A former tattoo artist admitted in court yesterday to sexually abusing and tattooing a Rochester boy. According to court documents Arthur Moore fled the city in March 20-10 after the victim’s mother found a tattoo on her son’s arm. He was arrested in February 20-11. Monroe County Court Judge Thomas Moran sentenced Moore to three years in state prison with ten years post release supervision. Moore also waived his right to appeal and will have to register as a sex offender when he’s released from prison.

A 24 year old woman was sentenced in Monroe County Court to time served and ordered to pay restitution after being convicted of bank fraud. U.S. Attorney Tiffany Lee says in the summer of 2008 Ashley Hall cashed counterfeit checks at various banks and retailers in New York City. Hall will also have to pay nearly 11 thousand dollars in restitution.

The Ontario County Sheriff’s Department responded to a call of a truck on fire at the intersection of County Road 19 and Route 21 in the Town of Hopewell. Authorities say 32 year old Robert Smith Junior of Clifton Springs told them his pickup truck started on fire while stopped at the intersection. Both Smith and a passenger in the vehicle – 26 year old Jessica Irwin also of Clifton Springs – both escaped the truck without injury. The truck was totally destroyed in the fire.

A 29 year old Ithaca man is under arrest on a felony rape warrant accusing him of having sex with a person under the age of 17. Tompkins County Sheriff’s Deputies arrested Jamel M. Riddick, charging him with third degree rape. Investigators say the charges stem from an incident in the Town of Dryden in December of 20-10. Riddick was arraigned in the Town of Dryden Court and then remanded to the Tompkins County Jail in lieu of 25 thousand dollars bail. He’s scheduled to appear in court again today for a preliminary hearing.

New York State Police – along with officers from several Monroe County Police Departments – chased a driver early yesterday morning. Greece Police say a 19 year old led officers through several towns before he was finally stopped on Norton Street in Rochester.

Meanwhile, according to the Greece Police Department, the teen originally called 9-1-1 claiming he was being followed. When officers located him, he drove off. The officers tried to pull him over but he refused to stop, leading police through Greece, Webster and then into Rochester. Authorities say it was not a high speed chase and an officer was on the phone with him trying to persuade him to pull over. Officers put out spike strips to to try to stop his car and that’s when he swerved and tried to hit a group of officers on the road. Investigators say the teen also hit a New York State Trooper Patrol car multiple times.

Kenneth J. Horan – a developer who failed to properly remove asbestos from a renovation project in Irondequoit – is facing one year in prison and a 10 thousand dollar fine. The 38 year old Horan of Pittsford pled guilty to violating the Clean Air Act and National Emission Standards in November of last year. Federal prosecutors say Horan supervised a renovation project at 48-66 Culver Road in October 2009 and he failed to comply with legally-required safety measures for removing asbestos.

The Ontario County Sheriff’s Department reports the arrest of 29 year old Michael James Tears of Clifton Springs on an arrest warrant issued from the Rochester Police Department on a charge of petit larceny. Officials say Tears was a passenger in a vehicle that was stopped by Sheriff’s Deputies on Main Street in the Village of Manchester. He was arrested and then turned over the the Rochester Police Department for further processing.

The Gorham Town Planning Board has started the process of imposing a one year moratorium on wholesale dog kennels. Leaders took action in response to public outcry over a proposed dog breeding facility in Gorham. The breeder, Curtis Martin, has been cited several times for problems at his current facility in the Seneca County Town of Varick. The moratorium would mean no new applications or permits could be issued. It will also give the planning board time to review the existing zoning laws. The moratorium now goes to the Ontario County planning board for approval.

A western New York woman announced yesterday that she’s running for Gabrielle Gifford’s seat in Congress. 28 year old Nomiki Konst – the daughter of former Erie County legislator Kathy Konst – is entering her first political race. If she wins, Konst would be the youngest Representative in Congress.

New York State Police executed search warrants yesterday as a result of animal cruelty allegations at the Wyoming County SPCA in Attica. Officials also say search warrants were executed at the Wyoming County SPCA Adoption Center located at the Eastern Hills Mall. State Troopers say they received complaints of animal cruelty and deplorable conditions within the past two weeks. Animals were removed from the Wyoming County Shelter yesterday with the assistance of the Erie County SPCA. Officials also say the Wyoming County District Attorney’s Office and the Erie County SPCA are both assisting with the investigation.

A 19 year old man is facing charges after an investigation into the sale of cocaine in Geneva. Authorities say Isaiah Waller – from Geneva – has been charged with criminal possession of a controlled substance. Geneva Police arrested Waller following a traffic stop. Officers on the scene report that Waller was selling crack cocaine prior to being stopped. He was also charged with aggravated unlicensed operation of a motor vehicle. According to court documents Waller also had several hundred dollars and with crack cocaine in his possession at the time of his arrest.

Students, parents and teachers all gathered at the Fairport School meeting last night as a sign of solidarity protesting some of the proposed budget cuts by the district. Those proposals include cutting approximately 37 jobs, along with several programs and classes to help fill the 4.5 million dollar budget deficit. School districts across the area and around New York State all say decreasing state and federal aid is also creating budget problems.

Five Rochester Knighthawks have been suspended by the National Lacrosse League after polie say they triggered a restaurant brawl early Monday morning. Police in a suburb outside of Minnesota charged Cody Jamieson, Jordan Hall, Sidney Smith, Travis Hill and Tyler Burton in connection with the incident. Investigators say the five players were sitting at a bar inside a TGI Friday’s restaurant when they started throwing food and other others items. At some point one of the players threw a menu which hit another patron and that’s when the fight started.

There’s one big name that will not be seen at the Oscars this year – Kodak. The Eastman Kodak Company received court approval yesterday to end its sponsorship deal for the Hollywood Theater which hosts the Academy Awards later this month. Kodak signed a 74 million dollar deal for naming rights to the theater in the year 2000. However, after filing bankruptcy last month the company also decided to end its contract for naming rights to the Los Angeles theater as it attempts to improve its financial picture.

The Captain of the Keuka Maid has been found not guilty by a Town of Milo jury of reckless operation of a vessel and interfering with navigation after the dinner boat ran aground in November 20-10 in Keuka Lake. Robert Hicks Junior was hired by the boats owner to take the vessel from Urbana – where it’s been docked for five years – to his lakefront property in Penn Yan near Sarrasin’s Restaurant.

Meanwhile, a civil lawsuit has been filed by the Keuka Maid’s owner – Robert Pfuntner, Hicks and other crew members in Yates County Supreme Court for falsely imprisoning them for more than nine hours as well as a charge of trespassing.

Governor Andrew Cuomo says he’s confident a deal will be in place today creating tougher teacher evaluations before the deadline passes today. However, if no deal on a “template” for evaluations for teachers and principals is set by the end of the day, the Governor says he will then impose his own in his budget amendments which gives the Governor extraordinary power. Hanging in the balance is approximately 1 billion dollars in federal aid that the state committed to in 20-10 when it won competitive grants based on school reform.

Eastman Kodak has asked the U.S. Bankruptcy Court in Manhattan to keep fees and other costs in its debtor-in-financing deal with Citi-Group Global Markets under wraps. It also won a bid to fast track the motion to put another fee deal under seal as well.

A Michigan man who pled guilty to a bomb hoax has been sentenced to 24 months in prison. An investigation by the Joint Terrorism Task Force revealed that on February 6 of last year, 59 year old Patrick C. Bassett called the Fairport High School from Michigan and left a voicemail message stating that there was a bomb in the girls locker room. At the time Bassett believed that the daughter of his ex-girlfriend was attending Fairport High School and he made the threat because of past issues with his ex-girlfriend. Bassett also admitted that – since approximately 2001 – he made numerous phone calls and sent letters to his ex-girlfriend and her family which they found to be threatening and harassing.

New York State Police arrested a 17 year old from Farmington for allegedly having child pornography on his computer. Police say the teen – whose name has not been released – had files on his computer depicting children under the age of 16 engaged in sexual conduct. Authorities seized his computer and charged the teen with the felony of possessing a sexual performance by a child.

On the ice Scott McDonald coaches the RIT Women’s Hockey Team which is currently ranked number one in the nation with a 21-1 and 1 record. However off the ice McDonald is now facing an assault charge stemming from a punch he threw during a men’s Recreational League game in December. The 35 year old McDonald pled not guilty to a third degree assault charge this week. The misdemeanor charge carries a maximum sentence of one year in jail.

The Rochester Knighthawks say five players were arrested after a fight at a Minnesota restaurant. Team President Lewis Staats said the five players were among a number of people involved in what was described as a “large fight at at TGI Friday’s in Bloomington, a suburb of Minneapolis. Staats said the players appeared in court and are now back in Rochester. He went onto to say the team is also conducting its own investigation into the incident.

A Honeoye man is accused of making threatening statements while holding an aluminum baseball bat after a domestic dispute. According to the Ontario County Sheriff’s Department 25 year old Sean Patrick Slayer of Berkley Street was charged with second degree menacing on Valentine’s Day. Slayer is scheduled to appear in Richmond Town Court at a later date to answer the charge.

A Monroe County grand jury has indicted a former Gates-Chili basketball coach on multiple counts of rape and criminal sex act. Monte Now-den is charged with two counts of rape in the third degree and one count of criminal sex act in the third degree. According to court documents they are all felony charges.

Meanwhile, the Monroe County District Attorney’s Office says the charges stem from conduct alleged to have happened not just in January as previously reported, but also this month. According to the Gates Police Department, Now-den allegedly had sexual contact with an underage female student January 30th at the Tinseltown Theaters. Prosecutors have not released details about the conduct alleged to have taken place this month. They’ve only said it took place with the same victim.

Jury selection got underway yesterday for a Henrietta teen accused of attempted murder for allegedly stabbing his 13 year old cousin. According to Sheriff’s Deputies with the Monroe County Sheriff’s Office, 16 year old Faheem Abdul-Jaleel claimed he acted in self-defense after being attacked by his cousin, Samina Quasim. Police say on June 20th of last year the teens got into an argument and Abdul-Jaleel allegedly stabbed Quasim in the garage of an apartment complex in Henrietta. Police say Quasim was stabbed several times in the upper torso and spent several months recovering in the hospital.

A nine year old girl is being treated for a gash to her head after she was hit by a car yesterday. Authorities say the accident took place last night around 5 o’clock near the corner of Bay Street and Cummings Street in Rochester. Officials say the girl was walking home from a corner store when she was hit. Investigators say charges are pending in the case.

Three students and two adults were injured and taken to various hospitals after a school bus and SUV collided in Rochester yesterday. Authorities say the morning accident took place at the intersection of State and Allen Streets. According to the Rochester City School District, the bus was transporting 14 elementary school students to school on its normal school run. Police say the bus had a green light and was crossing State Street when it was T-boned by the SUV as it ran a red light. The bus spun around, flipped over and landed on its side.

A woman accused of hitting a pedestrian last year while driving drunk has been indicted by a Monroe County grand jury. 22 year old Kashia M. Houston was indicted on a number of charges in connection with the case. Houston is accused of reading a text message when she hit a woman in November last year. 39 year old Sherry Argro was getting out of her parked car when she was hit. Houston fled the scene of the accident but was found a short time later at her home standing next to her damaged vehicle.

Greece Police officers are investigating a robbery at a Home Depot on West Ridge Road that took place yesterday afternoon. Investigators say the suspect stole thermostats from the store and tried to flee the scene. However an employee from the store chased after the suspect who was trying to leave the store and drive away. The employee suffered minor injuries in the attempt and the suspect did flee the scene.

Rochester firefighters say a fire in a single story house on Chesterfield Street was caused by a four year old with a cigarette lighter. Authorities also say the home was significantly damaged in the blaze, especially to the interior of the home. When firefighters arrived on the scene they found heavy smoke and flames pouring from the windows of the home. Authorities also report that an adult female and a four year old boy were the only ones home at the time of the fire. The woman received minor burns to her forehead. Firefighters also say the woman told them she tried to put the fire out herself before calling 9-1-1 which led to her injuries.

A 17 year old Greece Thunder hockey player is facing a misdemeanor assault charge following an altercation with a fellow player at the Lakeshore Hockey Arena last week. According to the Greece Police Department, Tyler Grim-shaw was charged with third degree assault in connection with the incident that took place during a team practice where the 14 year old victim suffered a concussion. Police say they were contacted about the incident by officials with the Greece Central School District and they then launched their own investigation.

Rochester Mayor Thomas Richards wants to spend two million dollars on further design work to realign and raise a portion of the Inner Loop that could strengthen the city’s request for federal funding for the project. Richards is counting on a separate federal grant to pay for much of the design contract with Stan-tec consultants. Federal transportation officials rejected the city’s initial application for close to 15 million dollars in funding last year to raise a one mile stretch of the Inner Loop along downtown’s east side.

Former Monroe County District Attorney Michael Green has landed a new job with Governor Cuomo’s administration. The Governor’s office says Green will serve as the Executive Deputy Commissioner of the Division of Criminal Justice Services. He will serve as senior counsel for criminal justice policy.

Meanwhile, Green was Monroe County’s D.A. for eight years before he was nominated to a federal judgeship by President Barack Obama. The Senate however blocked the appointment and the White House declined to re-nominate him.

A Buffalo man is under arrest on drug charges after Seneca County Sheriff’s Deputies responded to a burglar alarm going off at a business in Lodi. Officials say as Sheriff’s Deputies arrived on the scene 39 year old Joseph Bon-gio-vani was attempting to drive away. He was quickly apprehended and Deputies discovered he was in possession of a number of drugs. He was arraigned and then remanded to jail in lieu of 100 thousand dollars bail.

A new bill in Albany would crack down on drivers who carelessly hit bicyclists and pedestrians. The proposal would raise the sentence for a first offense to a 750 dollar fine and up to 15 days in jail. A second offense could result in a misdemeanor charge. Currently that law requires a police officer to witness the crash. However, the new law as proposed in the bill would require only that an officer has reasonable cause to believe the law was broken.

The trial for a Henrietta teen accused of brutally stabbing his cousin is set to begin today. Jury selection for Faheem Abdul Jaleel starts this morning. Jaleel is charged with first degree assault and police also say he admitted to stabbing 13 year old Samina Qasim last June in self-defense. Qasim was found behind a trash bin in her garage. After suffering what were considered life-threatening injuries at the time, she has since been released from the hospital.

The former Gates-Chili High School basketball coach charged with raping a female student appeared in court for a scheduled preliminary hearing last night in the Town of Gates. Monte Now-den was – who is currently out on bail – appeared in court with family members and a group of students also were in the courtroom showing their support. Prosecutors in the case decided not to move forward with a preliminary hearing and now the case will be presented to a grand jury. Now-den’s charges in the Town of Gates have been dismissed.

A middle school basketball coach in Livingston County has been relieved of his duties following what parents called an insensitive comment made at LeRoy High School last month. Former York Central School modified basketball coach Mike Falk is accused of gathering his team after a game in LeRoy and saying – quote – “1-2-3 Tourette’s”. Falk – who is also an eighth grade math teacher – is facing other accusations as well.

Rochester Police are investigating a shooting that took place last night on the city’s northwest side. Officials say the 9-1-1 call came in around 10 o’clock for a report of shots fired near Wilkins Street and Hudson Avenue. Police say when they were driving to the scene they saw a car driving on Hudson Avenue with no lights on. Officers pulled the car over and saw the driver had been shot several times in the arms and legs. Police also say the victim was drunk. The 31 year old man was transported to Strong Memorial Hospital where he is currently listed in stable condition.

The last man involved in a Rochester drug ring broken up in 20-10 pled guilty in federal court yesterday to multiple drug charges. 36 year old Hubart Simons was part of a drug conspiracy that distributed large amounts of cocaine, crack cocaine and heroin throughout the area between 2008 and 20-10. According to court documents, Simons – along with eleven others – were arrested by federal and state authorities after a year long investigation. Simons is the final defendant to enter a guilty plea related to a number of charges in the case.

A 21 year old Lyons man is under arrest charged with criminal impersonation following an investigation into a suspicious incident in the Village of Clyde. Wayne County Sheriff’s Deputies say Lorimus Desius gave officers his brothers’ name in an attempt to avoid being arrested on an out-standing warrant on a felony charge from the Village of Lyons. Desius was arraigned and then remanded to the Wayne County Jail in lieu of seven thousand dollars bail.

A Steuben County grand jury has upgraded a manslaughter charge to murder against a Corning man who allegedly killed his former live in girlfriend last November in the Town of Gibson. According to court documents Joseph Dixon is now facing a second degree murder charge after the grand jury convened.

Meanwhile, investigators say Dolores Warner was killed sometime on or shortly before Thanksgiving Day from a combination of blunt force trauma and asphyxiation. The 53 year old was found inside her home. State Troopers also say there had been a history of domestic violence between Dixon and Warner. Dixon – who is currently being held in the Steuben County Jail – is facing a maximum sentence of 25 years to life in prison if found guilty.

A former Gates Chili basketball coach made a court appearance yesterday. 38 year old Monte Now-den is accused of having sex with a student. According to court documents, Now-den and a 16 year old girl had sex last month inside the Tinsletown movie theater in Gates. Police say Now-den was arrested after a friend of the victim told a teacher Now-den was having an “inappropriate relationship” with a student. Now-den – who was also a teacher’s aide, was fired from the Gates Chili School District.

The Vice-Chairman of the National Transportation Safety Board testified yesterday at a New York Senate hearing on distracted driving. In December the federal agency called for a nationwide ban on driver use of portable electronic devices. Christopher Hart, the vice chairman of the agency, talked about the proposal at a Senate hearing in Albany. According to the National Highway Traffic Safety Administration, more than 54 hundred people were killed and an estimated 448 thousand were injured nationwide in crashes involving distracted driving in 2009.

Senator Charles Schumer was in Rochester yesterday calling for a law banning the sale of K2 Spice and other synthetic drugs. The proposed legislation is designed to prevent drug makers from tweaking their products to avoid federal bans. Officials say the drugs can lead to seizures, hallucinations, high blood pressure, rapid heart rate and panic attacks. They also say other side-effects include dangerous and erratic behavior.

Three people are under arrest after Ontario County Sheriff’s Deputies say they stole more than 22 hundred dollars from various stores throughout Eastview Mall. According to court documents the trio were in possession of merchandise stole from Abercrombie and Fitch, Express, Lord and Taylor, Hollister, JC Penny and American Eagle. They were also all remanded to the Ontario County Jail in lieu of five thousand dollars bail.

An accident-plagued intersection in Farmington will receive a traffic light this week. Officials say the intersection at Route 96 and County Road 28 has been the site of several serious accidents over the past year, including a January 7th crash that sent a 15 year old to the hospital. According to the Farmington Town Supervisor, the process to add the light first started two years ago. DOT spokesperson Lori Maher said putting up a traffic light can be a long process. It will be a flashing light for about one week to get drivers used to it before becoming a fully-functional three-color signal.

Livingston County Sheriff’s Deputies have charged a man with leaving the scene of a fatal motor vehicle accident after an incident yesterday morning. Sheriff’s Deputies charged 27 year old Michael Manley of Honeoye Falls with leaving the scene of a fatal motor vehicle accident, aggravated unlicensed operation of a vehicle and unlicensed operation of a motor vehicle.

Meanwhile, investigators say the charges stem from an overnight hours incident where Manley hit 51 year old William Ehr-men-traut. Authorities report that Ehr-men-traut’s body was found in a ditch along Route 15A around 8:30 yesterday morning. Manley called Monroe County 9-1-1 yesterday afternoon to report he had hit a deer. Further investigation revealed it was Ehr-men-traut that Manley hit. According to court documents Manley was arraigned in Lima Town Court and then remanded to the Livingston County Jail in lieu of 50 thousand dollars bail.

A family managed to escape a fire on MaComber Road in the Genesee County Town of Alabama yesterday morning. Officials say Peter Dart went upstairs to check on his 13 month old baby when he started to smell smoke. He and his family got out of the house and then called 9-1-1. The infant was transported to the hospital for treatment of smoke inhalation. It took fire departments from across Genesee County to get the three alarm fire under control. A tanker full of water was also brought to the scene as there wasn’t enough water nearby to fight the blaze. Fire investigators say the fire was caused by a blanket on an electric heater. The house was a total loss.

Rochester Police are investigating a stabbing incident that took place yesterday in a residence at the Hamilton apartment building on Mount Hope Avenue. Authorities report that an adult male victim was transported to the hospital for treatment of injuries that officers on the scene described as non-life-threatening injuries. The incident was related to a domestic dispute.

The Ontario County Sheriff’s Department reports the investigation of a single car crash on Kearney Road in Gorham yesterday afternoon. Sheriff’s Deputies say Margaret Lewis lost control of her vehicle on a corner and then crashed into the ditch. She was transported to F.F. Thompson Hospital for treatment of injuries sustained in the crash.

The 12th annual Polar Bear Plunge was held at Ontario Beach Park in Charlotte yesterday to benefit the Special Olympics on New York. Organizers say approximately 17 hundred people went into the cold waters of Lake Ontario for a good cause. Swimmers endured freezing temperatures along with windy and snowy conditions for a quick dip in the lake on what was also the most wintry weekend of the winter season so far. The event hoped to raise more than 200 thousand dollars for the program.

More than two million Time Warner Cable subscribers lost broadcasts of the NBA’s Knicks and the NHL’s Rangers, Devils, Islanders and Sabres on January 1st because of a dispute over rate increases between the cable company and MSG Network. Now MSG Media President Michael Bair says the dispute could last through the end of the leagues’ regular season in April. Time Warner spokeswoman Maureen Huff say MSG is demanding a 53 percent increase in the price Time Warner pays for its programming.

23 year old Maxwell Charles Wyant – the Brighton man accused of murder in connection with a fatal shooting last week – will make a court appearance tomorrow afternoon for a preliminary hearing in Brighton Town Court. Authorities say Wyant allegedly fatally shot his former roommate – 21 year old Christopher Schoen – while the two were arguing over a property dispute. Schoen was shot inside the home but rescue crews found him on the ground outside of the Hartfeld Drive home. Investigators also say a third man believed to be Wyant’s current roommate was also in the home at the time of the shooting. Wyant remains in the Monroe County Jail without bail.

The Waterloo Police Department investigating a weekend crash at the intersection of Route 5 and 96. Authorities say a vehicle operated by 26 year old Kristopher M. Campanello of Waterloo failed to stop at a red light and his vehicle hit a bus carrying the University of Rochester track team heading to a meet at Cornell University. After hitting the bus investigators say Campenello’s car then hit another car. Officers on the scene report that Campanello sustained minor injuries and refused treatment. No other injuries were reported in the crash.

A Rochester man is n custody after a standoff Friday night on Snug Harbor Court. According to the Rochester Police Department the man is accused of robbing a pizza delivery driver in the complex around 10 o’clock Friday night. He then entered one of the Snug Harbor town-homes with a gun. Authorities also reported there were children inside the home at the time. The Emergency Task Force responded and took the man into custody without incident early Saturday morning.

The State Attorney General is investigating Oak Hill Country Club and has issued subpoenas demanding employee files and information about video cameras that were installed in the men’s locker room. The club and its president and director – each of whom were served – have take legal action to quash the subpoenas claiming through their lawyers that the state’s demands are overly broad and harassing.

Meanwhile, their lawyers also accuse the Assistant Attorney General conducting the investigation of over-stepping his bounds when he allegedly threatened to refer the matter for criminal prosecution if the state’s demands were not met. Attorney General Schneiderman opened his investigation into Oak Hill in November after learning that surveillance cameras had been installed in the men’s locker room over the summer.

Another large employer in Rochester has announced layoffs are on the way. The 180 people who work at Cryovac Sealed Corporation – a food packaging plant on Brooks Avenue in Rochester – were recently told the plant will gradually shut down and they will each lose their jobs.
